Are you an employer with staff working in your business, or thinking of hiring someone soon? It’s important to understand the laws to make sure you are in compliance in order to avoid any penalties that could be assessed for non-compliance. The Fair Labor Standards Act (FSLA) establishes rules regarding minimum wage, overtime pay, recordkeeping and youth employment for those involved in the private sector and federal, state, and local governments. We’ll discuss those who are exempt from the FSLA and those who fall under the regulations. Descriptions on meanings of the terms within the law will be explained as well as understanding the differences between an employee and an independent contractor. I’ll explain the three factors used to judge if the worker is an employee, and the categories within each factor to review. Failing to follow guidelines can result in fines/penalties, so learn the rules so you can be in compliance.
