Buried in proposed legislation called Helping Families Save Their Homes Act (HR 1106) is a "stealth provision" that grants loan servicers such as banks retroactive immunity from lawsuits if they perform loan modifications. Talcott J. Franklin, co-author of a new book on the securitization meltdown entitled the "Emergency Economic Stabilization Act Handbook," will talk about the impact of that provision with Micah Green, a partner at Patton Boggs LLP, who represents a new coalition of mortgage investors. The Senate is expected to take this up soon. It's a hot topic. Giving blanket immunity to the banking industry could affect mortgage backed securities which are held by pension funds, 401-K investments, life insurance policies, college funds and other managed investments.
